Welcome to Casa. By accessing or using Casa's website, mobile application, or any services we provide (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). Please read these Terms carefully before using the Services. These Terms constitute a legally binding agreement between you and Home Technologies Inc. (d/b/a Casa), a Delaware corporation.
"Agreement" means these Terms together with the Casa Privacy Policy, Community Guidelines, and any other policies, addenda, or product-specific terms incorporated herein by reference.
"Casa," "we," "us," or "our" means Home Technologies Inc. (d/b/a Casa), a Delaware corporation, and its successors, affiliates, officers, directors, employees, agents, and licensors.
"CasaQuote™" means Casa's proprietary AI and machine learning–powered automated home valuation model.
"Claim" means any dispute, controversy, or claim of any kind arising between you and Casa, including claims arising under contract, tort, statute, or any other legal or equitable theory.
"Services" means Casa's websites, mobile applications, interactive map tools, agent ranking features, in-platform messaging, CRM tools, the CasaQuote™ valuation engine, and all related features, content, and functionality.
"User Content" means any data, photographs, reviews, listing information, messages, communications, or other materials you submit, upload, or transmit through or in connection with the Services.
"Pro Use" means use of the Services by a licensed real estate professional acting in their professional capacity on behalf of clients.
Casa operates a video-first home search platform that provides access to property listings, neighborhood market data, agent rankings, AI-powered home valuations via CasaQuote™, agent messaging, a real estate CRM, and related tools.
Casa is not a licensed real estate broker and does not provide financial, legal, real estate, tax, insurance, or investment advice of any kind. All Services are purely informational and do not constitute a professional recommendation or representation as to the suitability of any property, agent, or transaction.
Casa does not represent buyers, sellers, landlords, tenants, or agents in any transaction unless explicitly provided in a separate written agreement signed by an authorized Casa representative. Casa assumes no responsibility for any result or consequence related, directly or indirectly, to any action or inaction taken based on information accessed through the Services.
Casa may display third-party advertisements. To learn how we use your information for advertising and other purposes, please review our Privacy Policy.
Casa offers the following suite of tools and features, which may be added to, modified, or discontinued at any time without prior notice at Casa's sole discretion:
You must be at least 18 years of age, or the age of majority in your jurisdiction if higher, to use the Services. Persons under the age of 13 may not use the Services under any circumstances. By accessing or using the Services, you represent and warrant that: (a) you meet the applicable age requirement; (b) you have not previously been suspended, removed, or barred from the Services; and (c) your registration and use comply with all applicable laws and regulations.
To access certain features, you must register for an account. All accounts require a valid email address, which serves as your login username. You agree to provide accurate, current, and complete information — including a valid email address — and to keep such information updated at all times. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not share, sell, or transfer your account to any third party. Casa accounts are non-transferable.
Casa has no liability arising from your failure to maintain accurate contact information or your failure to receive any critical notices about the Services.
Subject to your full compliance with these Terms, Casa grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services solely for: (i) your own personal, non-commercial purposes; or (ii) Pro Use. This license does not include any right to sublicense, resell, or commercially exploit the Services or any content therein. If you engage in Pro Use, you represent and warrant that you have obtained all required authorizations, consents, and disclosures from your clients.
Casa may offer mobile applications ("Apps"). You are responsible for any data charges incurred from your wireless carrier in connection with use of an App. Casa may issue automatic updates to Apps, and your continued use of any App constitutes your acceptance of the updated version and these Terms. Any open-source software included in Casa's Apps is subject to its applicable open-source license.
You may access and view content available through the Services for personal or Pro Use only. You may not reproduce, redistribute, retransmit, or commercially exploit any content without Casa's prior written permission. Aggregate market data may be used for personal real estate research, provided that Casa is cited as the source on every page or presentation where such data is displayed.
By using the Services, you expressly agree NOT to:
Certain features of the Services may require payment. All fees are denominated in U.S. dollars and are non-refundable except as otherwise expressly stated or required by applicable law. Casa will provide advance notice of any changes to fees. Your continued use of any paid feature after a fee change constitutes your acceptance of the revised fee.
Certain Services may be offered on a recurring subscription basis. By activating a subscription, you authorize Casa to charge the applicable fees to your designated payment method on a recurring basis until you cancel. You must cancel prior to the start of the next billing cycle to avoid being charged for that cycle. Casa may change subscription fees for future periods with advance notice. You may cancel via your account settings or by contacting Info@CasaAnalytics.com.
By providing a valid payment method, you authorize Casa to charge all applicable fees, including any taxes or surcharges, to that payment method. Casa may seek pre-authorization of your payment method prior to processing any charge. All fees are exclusive of applicable taxes, which are your sole responsibility.
By submitting User Content, you grant Casa a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify (for formatting or display purposes), distribute, publicly display, publicly perform, and create derivative works from your User Content in connection with operating, promoting, and improving the Services. Casa will not compensate you for your User Content or for the exercise of these rights.
You represent and warrant that: (i) you are the creator or have all necessary rights, licenses, consents, and permissions to submit your User Content and to grant the license above; (ii) your User Content does not infringe any third-party intellectual property, privacy, publicity, or other rights; (iii) your User Content does not contain obscene, defamatory, abusive, harassing, or illegal content; and (iv) if you submit a review or testimonial, it reflects your genuine, uncompensated experience, and you disclose any incentive or consideration you received.
You are solely responsible for your User Content. Casa is not obligated to monitor, review, or edit User Content but reserves the right, in its sole discretion, to remove or block any User Content at any time and without prior notice. Casa disclaims all liability for User Content submitted by any user.
Listings may only be posted by the property owner or the contracted exclusive listing agent. If you are a licensed agent submitting a listing, you represent and warrant that: (i) the property owner has expressly authorized the submission; (ii) your employing broker has authorized the submission; (iii) you have complied with all applicable MLS rules, licensing requirements, and regulatory obligations; and (iv) all information submitted is accurate and complete to the best of your knowledge and belief.
All User Content must comply with these Community Guidelines. Casa may remove, edit, or block any content that violates these guidelines in its sole discretion and without prior notice.
The Services may contain links to or integrations with third-party websites, services, or tools, including mapping services, background check providers, and other real estate resources. Casa does not control and is not responsible for any third-party content, products, services, or privacy practices. Your use of any third-party service is governed solely by that party's own terms of use and privacy policies, which you are solely responsible for reviewing and complying with.
If you connect with a real estate agent or other professional through the Services, Casa may facilitate that introduction but is not a party to any resulting transaction, agency relationship, or professional engagement. Casa does not endorse, vet, or guarantee the quality, licensure, or performance of any agent or professional accessible through the Services.
If you submit a contact form or otherwise indicate interest in connecting with a third party, you may receive communications from that third party using the contact information you provided. Third parties may retain your contact information in accordance with their own privacy policies. Casa is not responsible for any damages arising from your interactions with any third party.
CasaQuote™ is an automated home valuation tool powered by AI and machine learning algorithms. CasaQuote™ valuations are estimates only and do not constitute a formal appraisal, broker price opinion, comparative market analysis, or any other professional valuation service.
CasaQuote™ estimates may differ significantly from the actual market value of any property. Estimates are derived from algorithmic models analyzing publicly available data and are not based on a physical inspection of any property or the exercise of professional judgment. Casa makes no representations or warranties, express or implied, as to the accuracy, completeness, timeliness, or reliability of any CasaQuote™ estimate.
Users should consult a licensed appraiser or qualified real estate professional before making any financial, legal, tax, or transactional decision based in whole or in part on a CasaQuote™ valuation. No CasaQuote™ estimate shall be considered a comparative market analysis, formal appraisal, or opinion of value for any purpose.
Certain listing data displayed through the Services is sourced from third-party Multiple Listing Services ("MLS"). By accessing such listing data, you acknowledge and agree that:
Casa does not assert copyright ownership in the underlying images or descriptions of real estate listings provided through third-party MLS sources. Any use of such images or descriptions is subject to the applicable copyright owner's permission and applicable law.
The Services and all content, features, and functionality — including text, graphics, logos, data, software, the CasaQuote™ model, and the compilation and arrangement of all content — are owned by Casa or its licensors and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws. Except as expressly permitted by these Terms, you may not use, copy, reproduce, distribute, modify, create derivative works from, reverse engineer, or otherwise exploit any Casa content without Casa's prior written permission.
You may not use any Casa name, trademark, service mark, graphic, or logo without Casa's specific prior written permission. You may not use meta-tags or hidden text using any Casa mark.
If you provide suggestions, ideas, or feedback regarding the Services ("Feedback"), you hereby assign to Casa all right, title, and interest in and to that Feedback. To the extent such assignment is not permitted by applicable law, you grant Casa a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use the Feedback for any purpose. You waive any moral rights in the Feedback to the fullest extent permitted by law. Casa will not compensate you for Feedback.
Casa respects the intellectual property rights of others and expects all users to do the same. It is Casa's policy, in appropriate circumstances, to terminate the accounts of users who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.
If you believe that content on the Services infringes your copyright, please submit a written notice to Casa's Copyright Agent that includes all of the following:

If your content was removed following a copyright notice and you believe the removal was erroneous, you may submit a counter-notification to the Copyright Agent that includes: (i) your electronic or physical signature; (ii) identification of the removed material and its prior location; (iii) a statement under penalty of perjury of your good-faith belief that the material was removed by mistake or misidentification; (iv) your name, address, telephone number, and email address; and (v) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located. Upon receipt of a valid counter-notification, Casa may restore the material within 10–14 business days unless the claimant files a court action seeking a court order.
Knowingly misrepresenting that material is infringing, or that it was removed by mistake or misidentification, may subject you to civil liability under 17 U.S.C. § 512(f).
Casa collects, uses, and discloses personal information in accordance with the Casa Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the data practices described in the Privacy Policy.
By registering or using the Services, you consent to receiving electronic communications from Casa, including emails, push notifications, and in-app messages related to your account and the Services. You may opt out of non-essential marketing communications at any time through your account settings or by following the unsubscribe instructions included in each message.
Casa's messaging platform may record or monitor calls and messages for quality assurance, compliance, and safety purposes. By initiating or receiving a call or message through the Services, you expressly consent to such recording and monitoring to the fullest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless Casa and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your access to or use of the Services; (b) your breach or alleged breach of these Terms; (c) your User Content; (d) your violation of any applicable law or the rights of any third party; (e) any dispute between you and any third party arising from your use of the Services; or (f) your negligence or willful misconduct.
Casa reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to fully cooperate with Casa's defense and to assert any available defenses.
Before initiating any arbitration or court proceeding, you and Casa agree to first attempt to resolve any Claim informally for a period of at least sixty (60) days. To initiate informal negotiation, you must send written notice of your Claim to Casa at Info@CasaAnalytics.com or by certified mail to 950 Columbus Ave, Unit 4, San Francisco, CA 94133. Your notice must include: (a) your full name and current contact information; (b) a clear description of your Claim and all supporting information; and (c) the specific relief you are seeking, including any monetary amount. Casa will attempt to respond within thirty (30) days of receipt. Neither party may commence arbitration or file a court proceeding until the sixty (60)-day period has concluded without resolution.
If informal negotiation does not result in resolution, you and Casa agree that any Claim shall be resolved exclusively by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules, as modified by these Terms. The arbitration shall take place in the county of your primary residence, unless both parties mutually agree to an alternative location. The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award on an individual basis, including declaratory and injunctive relief.
All filing, administrative, and arbitrator fees shall be governed by the AAA's Consumer Arbitration Rules. If you initiate arbitration, Casa will reimburse your AAA filing fee at the conclusion of the arbitration to the extent it exceeds the filing fee that would have applied to the same Claim in federal court.
You have the right to opt out of binding arbitration entirely. To exercise this right, you must send a personally signed, written notice of your intent to opt out to Info@CasaAnalytics.com or by certified mail to 950 Columbus Ave, Unit 4, San Francisco, CA 94133 within thirty (30) days of the date you first agree to these Terms. Opting out of arbitration does not affect any other provision of these Terms.
YOU AND CASA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
If the Class Action Waiver is found to be unenforceable with respect to any particular Claim, then the arbitration agreement in Section 17.2 shall be null and void solely as to that Claim. All other Claims shall continue to be resolved through binding individual arbitration.
Nothing in this Section 17 prevents either party from: (i) seeking emergency injunctive or equitable relief from a court of competent jurisdiction to prevent imminent, irreparable harm; (ii) filing an individual Claim in a small claims court of competent jurisdiction; or (iii) filing a charge or complaint with, or participating in any investigation or proceeding before, a state, federal, or other governmental agency.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. For any Claims not subject to arbitration under these Terms, you and Casa submit to the exclusive personal jurisdiction of the state and federal courts located in New Castle County, Delaware and irrevocably waive any objection to jurisdiction or venue in such courts.
THE SERVICES ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASA AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, ACCURACY, TITLE, AND NON-INFRINGEMENT; (B) WARRANTIES ARISING THROUGH COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE; AND (C) ANY WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
CASA DOES NOT CONTROL OR VET THIRD-PARTY CONTENT FOR ACCURACY AND TAKES NO RESPONSIBILITY FOR ANY THIRD-PARTY CONTENT, ACTIONS, OR OMISSIONS. CASA IS NOT RESPONSIBLE FOR ANY ERRORS, INACCURACIES, DELAYS, OR OMISSIONS IN ANY CONTENT PROVIDED THROUGH THE SERVICES, OR FOR ANY LOSS OR DAMAGE ARISING FROM YOUR RELIANCE ON SUCH CONTENT. YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING LOSS OF REVENUE, PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH CLAIM IS BASED AND EVEN IF CASA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CASA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (1) THE TOTAL AMOUNT YOU PAID TO CASA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (2) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, Casa's liability will be limited to the fullest extent permitted by applicable law.
Casa is committed to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation. Casa encourages and supports an affirmative advertising and marketing program in which there are no barriers to obtaining housing because of race, color, religion, sex, sexual orientation, gender identity or expression, disability, familial status, national origin, ancestry, marital status, source of income, or any other legally protected characteristic under applicable federal, state, or local law.
Casa requires all users of the Services to comply in full with the Fair Housing Act (42 U.S.C. §§ 3601 et seq.), the Equal Credit Opportunity Act, and all other applicable anti-discrimination and fair housing laws. Violation of this requirement may result in immediate termination of your account.
You may deactivate your account at any time by visiting your account settings or by contacting Info@CasaAnalytics.com. Casa reserves the right, in its sole discretion, to suspend or terminate your access to all or any portion of the Services at any time, with or without cause or notice, including for any violation of these Terms. Upon termination, all licenses granted to you under these Terms shall immediately and automatically terminate. You shall remain obligated to pay any fees or amounts accrued prior to the effective date of termination.
The following Sections shall survive any termination or expiration of these Terms: Sections 6, 8, 11, 13, 14, 16, 17, 18, 19, and 22.
A. Entire Agreement. These Terms, together with the Privacy Policy and any applicable addenda or product-specific terms, constitute the entire agreement between you and Casa with respect to the Services and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
B. Amendments. Casa may amend these Terms at any time by posting revised Terms to the Services or by providing you with reasonable advance notice of material changes. Your continued use of the Services following any amendment constitutes your binding acceptance of the revised Terms.
C. Severability. If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
D. No Waiver. Casa's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future. No waiver of any breach shall be deemed a waiver of any subsequent breach.
E. Assignment. Casa may freely assign these Terms, in whole or in part, without prior notice to you. You may not assign any of your rights or obligations under these Terms without Casa's prior written consent, and any purported assignment in violation of this provision shall be null and void.
F. Beta / Testing. Certain features may be offered in alpha, beta, or pre-release form. Unless otherwise specified in a separate agreement, your participation in any testing is subject to these Terms. Beta features are provided "as is" and "as available" without any warranty of any kind.
G. Export Compliance. You agree not to export or re-export any portion of the Services in violation of any applicable U.S. or foreign export control laws and regulations.
H. No Injunctive Relief. Except as expressly permitted in Section 17.5, you may not seek or obtain rescission, injunctive, or other equitable relief against Casa, or seek to enjoin or restrain the operation of the Services or any Casa business activity.
I. Electronic Communications. You agree that any notices, disclosures, agreements, or other communications that Casa sends to you electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law.
J. Force Majeure. Casa shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental actions, power or internet outages, or any other event outside Casa's reasonable control.
Under California Civil Code Section 1789.3, California residents are entitled to the following specific consumer rights notice: If you have a complaint regarding the Services, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite S-202, Sacramento, CA 95834, or by telephone at (800) 952-5210.
If you access Casa's mobile application on an iOS device, the following terms apply as between you, Casa, and Apple Inc. ("Apple"): These Terms are between you and Casa only, not with Apple. Apple is not responsible for the Services or any related content or materials and has no obligation to provide any maintenance, support, or warranty services with respect thereto. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Services. Apple is not responsible for addressing any claim relating to the Services, including product liability claims, claims arising from a failure to conform to any applicable legal or regulatory requirement, or claims under consumer protection legislation. In the event of any third-party intellectual property infringement claim relating to the Services, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim. You agree to comply with all applicable third-party terms when using the Services. Apple and its subsidiaries are intended third-party beneficiaries of this Section 24 and, upon your acceptance of these Terms, will have the right to enforce this Section against you.
